Terms of Service

1. Acceptance of Terms

By accessing or using Punchcard (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms constitute a legally binding agreement between you and Punchcard.

2. Description of Service

Punchcard is a loyalty rewards platform for bars and restaurants. The Service allows:

• Customers to earn loyalty points at participating venues by scanning QR codes
• Customers to track rewards across all participating bars and restaurants in one place
• Customers to redeem earned rewards at eligible venues
• Venue owners to create and manage loyalty programs, deals, and events for their establishment
• Venue owners to view anonymized analytics about their loyalty program performance

Punchcard reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. User Accounts

To use Punchcard, you must sign in using OAuth authentication via Apple or Google. By signing in, you authorize Punchcard to receive your basic profile information (name, email address) from the selected identity provider.

You are responsible for maintaining the security of your linked Apple or Google account and for all activity that occurs through your Punchcard account. You must notify us immediately at support@punchcard.app if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Fraudulently earn or redeem loyalty points (e.g., scanning QR codes without visiting the venue)
• Use bots, scripts, or automated tools to interact with the Service
• Attempt to reverse-engineer, bypass, or exploit any part of the rewards system
• Share your account with others to gain unauthorized rewards
• Impersonate a venue, staff member, or other user
• Use the Service in any way that violates applicable law or regulation

Violations of these terms may result in immediate account suspension or termination, and forfeiture of any accumulated loyalty points or rewards.

5. Venue Owner Terms

If you register as a venue owner on Punchcard, you additionally agree to:

• Provide accurate and up-to-date information about your venue, including name, address, and contact details
• Ensure all deals, specials, and events listed on your venue profile are accurate and honored when customers present valid rewards
• Not create misleading, deceptive, or fraudulent offers that exploit the loyalty program
• Take responsibility for QR code security at your venue to prevent unauthorized scans
• Comply with all applicable local laws regarding promotions, alcohol service, and consumer protection

Punchcard reserves the right to remove or suspend venue listings that violate these requirements or that receive sustained negative reports from customers.

6. Intellectual Property

All content, design, code, and trademarks in the Punchcard Service are the property of Punchcard and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission. User-submitted content (such as venue reviews) remains your property, but you grant Punchcard a non-exclusive license to display it within the Service.

7. Limitation of Liability

To the maximum extent permitted by law, Punchcard is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of loyalty points due to venue closures, system errors, or account termination. The Service is provided “as is” without warranty of any kind. Punchcard's total liability to you for any claim shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

8. Termination

You may delete your Punchcard account at any time from your account settings. Upon deletion, your loyalty points and rewards history will be permanently removed. Punchcard may terminate or suspend your account at any time for violations of these Terms. Sections covering Intellectual Property, Limitation of Liability, and Governing Law survive termination.

9. Changes to Terms

We may update these Terms of Service from time to time. We will notify registered users of material changes via email or an in-app notification. Continued use of Punchcard after changes take effect constitutes acceptance of the revised terms. We recommend reviewing these terms periodically.
